Employee claims based upon allegations of sexual harassment, employee discrimination, retaliatory and/or wrongful termination, and the like are serious matters that can forever impact the employee’s life while, at the same time, irreversibly damage a business. As a result, the need to rely on an experienced HR director is now more important than ever before in an environment that appropriately encourages and supports victims to speak out and to tell their story.
Throughout our careers as practicing attorneys, HR consultants, educators, and board presidents, we have found that most small-to-medium sized enterprises choose not invest in HR or employment law resources because it is cost prohibitive for many to hire a full-time HR director or in-house lawyer. Instead, they chose to “go at it alone” without the necessary policies, procedures, and experience in place. As we have seen, that sort of an approach is dangerous and will likely cost the business much more in the long run.
A 2015 national study of small-to-medium-sized enterprises (between 20 and 300 employees) concluded that it costs an average of $125,000.00 to defend against a single employment discrimination or harassment claim. On average, those matters took 275 days to complete. The median judgment resulting from those same employment claims was approximately $200,000.00 per claim. The focus and attention of restaurant owners and managers are also drained as those in leadership positions will be required to remain actively involved in the defense of employment claims throughout the discovery process. Even if the business is successful in defeating the claim, significant time, energy, and financial resources are wasted during the process. Perhaps, more importantly, as we have seen, the ultimate reputation of the business can be severely and potentially irreversibly damaged.
The investment numbers are equally staggering when a small business elects to hire someone to serve as an in-house lawyer or HR director. Currently (as of September 27, 2017), the medium annual associate General Counsel salary in New Orleans is $205,129 with a range usually between $173,856 – $239,220 exclusive of bonus, benefits, overhead, and other cost factors. The median annual salary for a Human Resources Director in New Orleans is $97,557, with a range usually between $85,813 – $109,825 per year, exclusive of bonus, benefits, overhead, and other cost factors. This sort of investment is not feasible for many enterprises.

While there is a handful of HR consulting firms, those consultants are not lawyers and cannot provide the level of comfort that comes with sound, experienced legal advice. In fact, we know of no other law firm in the Gulf South wiling to offer this extensive bundle of services for a fixed fee rate. At the end of the day, this approach encourages businesses to use and rely on us as their “inside” counsel on a regular basis while, at the same time, provides the client with a fixed cost that that it can properly budget without having to worry about surprising and unexpected HR legal issues. Of course, our clients may still engage us on a project-by-project basis for a fixed fee or on per hour basis if that approach works best.
